Senator Owan Enoh of APC. vs INEC, Prof. Ben Ayade of PDP : Tribunal adjourns, Sine die, for Judgement

The Cross River State Governorship Elections Petition Tribunal sitting in Calabar, has reserved judgement in the petition filled by the State APC candidate for the March 9 Governorship Elections, Senator John Owan Enoh till further notice.

Sen.Enoh had filed a petition challenging the outcome of the elections wherein he moved against his wrongful exclusion from the elections by the INEC and urged the tribunal to quash the said elections while declaring a rerun poll in he state.

At the resumed hearing today,the parties had submitted and adopted their written addresses. Counsel to the petitioner,Awa Kalu(SAN) had stated that though the state chapter of the party was in crisis of leadership,it did not obliterate the place of the national leadership of the party to choose it's candidates adding that the issue of the APC not fielding a candidate in the election due to the crisis as raised by the Respondents was out of place.

He also sited additional authorities from the Zamfara example among others to accentuate the argument that the Petitioner was excluded from the March 9 polls.
Counsels to first Respondent (Been Ayade)Paul Erokoro(SAN) and of the second Respondent,(INEC),Ademola Adeshina held that the APC was enmershed in crisis that foreclosed it from having a candidate for the elections and therefore urged the tribunal to dismiss the petition altogether as it's 'interñal crisis cannot affect the victory of the PDP.'

Chairman of the Tribunal, Justice Josiah Majemi expressed happiness with the maturity demonstrated by Counsels throughout the proceedings while also ruling out compromise by the tribunal in the course of the litigation.
He announced that parties will be duly communicated on the date of the judgement.
